Welcome to XSStudiosco (“XSStudiosco,” “we,” “us,” “our”). We operate this website and store to provide you access to our products and services (the “Services”). The Services are powered by Shopify.

By using the Services, you agree to these Terms of Service (“Terms”) and our Privacy Policy (see the Privacy Policy link in our site footer). If you do not agree, do not use the Services.

1. ACCESS & ACCOUNT

You represent you are the age of majority in your state/province. You are responsible for your account credentials and all activity under your account. Information you provide (email, billing, shipping, payment) must be accurate and current.

2. OUR PRODUCTS

We try to display products accurately, but colors/appearance can vary by device. Descriptions, availability, and pricing may change without notice. We may limit quantities or discontinue items at our discretion.

3. ORDERS

When you place an order, you offer to purchase; we may accept or decline at our discretion. Orders are accepted once payment is processed and we send confirmation. Please review carefully before submitting—we generally cannot cancel after acceptance. Purchases are for personal use (no resale or export without consent).

4. PRICES & BILLING

Prices can change without notice. The price at checkout is the price in effect. Unless stated otherwise, prices exclude taxes, shipping, handling, customs, and import duties. You agree to provide valid payment details and authorize us (and our payment processors) to charge the total shown.

5. SHIPPING & DELIVERY

Delivery times are estimates only. We aren’t liable for carrier delays, customs processing, or events beyond our control. Title and risk of loss pass to you when we hand orders to the carrier.

6. RETURNS / ALL SALES FINAL

Because our hats are produced in limited runs and often customized, all sales are final—no returns, exchanges, or cancellations.

If an item arrives damaged or defective, contact us within 7 days of delivery with photos and your order number at xsstudios.co@gmail.com so we can review and, where required by law, repair/replace or provide another remedy.

7. INTELLECTUAL PROPERTY

All content, designs, logos, graphics, and site materials are owned by XSStudiosco or licensors and protected by law. You may not use, copy, or create derivative works without our written permission. Shopify and other third-party trademarks belong to their owners.

8. OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools or link to third-party sites. These are provided “as is.” We aren’t responsible for their content, terms, or policies; use them at your own risk.

9. PROHIBITED USES

Don’t use the Services for unlawful, infringing, harmful, misleading, or disruptive activities; don’t attempt to circumvent security; don’t spam, scrape, or interfere with operation.

10. FEEDBACK

If you submit reviews or suggestions (“Feedback”), you grant us a worldwide, royalty-free license to use and display them. You must have the rights to any Feedback you provide.

11. DISCLAIMER OF WARRANTIES

Except as expressly stated by us, the Services and products are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free use. Some jurisdictions don’t allow certain disclaimers; those limits may not apply to you.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, XSStudiosco and our affiliates are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, data, or revenue) arising from your use of the Services or products.

13. INDEMNIFICATION

You agree to indemnify and hold harmless XSStudiosco and our partners/affiliates from claims arising out of your breach of these Terms or misuse of the Services.

14. SEVERABILITY; WAIVER; ENTIRE AGREEMENT

If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision isn’t a waiver. These Terms plus the policies in our footer are the entire agreement.

15. ASSIGNMENT

You may not assign these Terms without our consent. We may assign without notice.

16. GOVERNING LAW

These Terms are governed by the laws of Illinois, USA, and applicable federal law. You consent to the state and federal courts located in Illinois for any disputes.

17. CHANGES TO TERMS

We may update these Terms at any time by posting the revised version on our site. Continued use means you accept the changes.
